Neighbourhood character overlay in Queensland — what it means if you want to build

An overlay is an extra layer of planning rules that sits on top of a property's zone.

What it is

Older streets whose look the council wants to keep: pre-war houses, timber-and-tin Queenslanders, tree-lined streets, consistent roof lines. It is a lighter touch than heritage, because the houses are not individually listed.

What it means for you

Demolishing or moving an older house, changing the street-facing side, or building a new house in the area may need a development application. You can usually renovate the back and the inside freely, but plan to match the character in the front.

  • Brisbane

    Brisbane City Plan 2014

    • Dwelling house character overlay (Table 5.10.9)

      A new dwelling house (incl. secondary dwelling) in the Low density, Low-medium density, Medium density or Character residential zone becomes accepted subject to requirements if it complies with the Dwelling house code / Dwelling house (small lot) code, otherwise code assessable. In the High density residential or Tourist accommodation zone a new dwelling house becomes impact assessable. Extensions become accepted subject to requirements, otherwise code assessable.

    • Traditional building character overlay (Table 5.10.21)

      New dwelling house, dual occupancy, multiple dwelling, rooming/short-term accommodation become code assessable (design overlay). Demolition/removal/repositioning of a building constructed 1946 or earlier (various criteria) becomes code assessable (demolition overlay) unless in a Heritage sub-category.

    • Commercial character building overlay (Table 5.10.7)

      MCU for commercial character building / centre activities and demolition of a commercial character building become accepted subject to requirements or code assessable.

  • Cairns

    CairnsPlan 2016

    • Neighbourhood character overlay (Tables 5.5.h, j, l (material change of use); 5.5.a, b, c, e.1, e.2, g, h, j, l, n.1, n.3, o, p, t.1, v (building work))

      In the residential zones a dwelling house (including a granny flat), dual occupancy or home based business becomes code assessable (shops and cafés too in Mixed use precinct 1); removing, repositioning or demolishing a building becomes code assessable.

    • Neighbourhood character overlay — Freshwater (area 6) and Stratford (area 11) (Tables 5.5.h, 5.5.j)

      A dual occupancy on a lot under 800 m² (Low density residential) or 600 m² (Low-medium density residential), or a subdivision creating a lot under 600 m² (Low density) or 450 m² (Low-medium density), becomes impact assessable.

    • Neighbourhood character place — Area B (Schedule 1) (Tables 5.5.a, b, c, e.1, e.2, g, h, j, l, n.1, n.3, o, p, t.1, v (building work rows))

      Building work (including minor building work on a site with an existing house, dual occupancy or multiple dwelling) within Area B of a neighbourhood character place becomes code assessable.

  • Ipswich

    Ipswich City Plan 2025

    • Character Places and Areas Overlay (Table 5.9.3)

      In Local Character Areas, a dwelling house (including secondary dwelling) or dual occupancy involving building work becomes code assessable. Other building work is accepted subject to requirements. Demolition of a pre-1946 building (other than a class 10 building) is impact assessable (needs a development application with public notification); demolition of a pre-1946 class 10 building is code assessable. All reconfiguring a lot is code assessable. For individual places of local significance / Schedule 7 listings, all building work other than demolishing an ordinary class 10 building is code assessable and pre-1946/listed demolition is impact assessable.

  • Mackay

    Mackay Region Planning Scheme 2017

    • Landscape character and image corridor overlay (Table 5.10.10)

      Within a landscape character area or on land adjoining an image corridor, a material change of use (other than a dwelling house, home-based business, new uses in an existing building and some rural uses) and any reconfiguring a lot become code assessable.

  • Rockhampton

    Rockhampton Region Planning Scheme 2015 (Version 5, 2025-03-28)

    • Character overlay — residential character design control area (Table 5.9.5)

      A dwelling house that would otherwise be accepted becomes accepted subject to requirements; extensions, external alterations and minor building work become accepted subject to requirements (must meet the Character overlay code).

    • Character overlay — residential character demolition control area (Table 5.9.5)

      Partial demolition of the front façade of a dwelling house becomes code assessable; total demolition, relocation on site or relocation offsite becomes impact assessable.

    • Character overlay — commercial character demolition control area (Table 5.9.5)

      Minor partial demolition of a front façade becomes code assessable; total demolition or relocation becomes impact assessable.

  • Toowoomba

    Toowoomba Regional Planning Scheme 2012 (Version 29)

    • Neighbourhood Character Overlay (Table 5.10:1)

      A dwelling house (as a material change of use) becomes code assessable; a dual occupancy or multiple dwelling becomes impact assessable, as does reconfiguring a lot that creates a hatchet lot or a lot under 450m².

    • Neighbourhood Character Overlay (Table 5.7:1; Table 5.10:1)

      On a neighbourhood character place, additions in the front half of the house increasing floor area by more than 25m² or 5% (whichever is less) are code assessable, a Class 10a building is accepted subject to the Neighbourhood Character Overlay Code, and demolition or removal of the front half is impact assessable.
